The Supreme Court rules against unreasonable attorney fees

India’s Supreme Court on Tuesday delivered a landmark judgment that says state bar associations cannot charge exorbitant fees for enrollment of lawyers seeking to join the bar. This judgment addresses the widespread issue of systemic discrimination faced by economically weaker and marginalized groups.

The bench, comprising Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra, declared that the Bar Associations are bound by the taxation policy laid down in the Advocates Act, 1961. Accordingly, the enrollment fees shall be capped at Rs 750 for general category applicants. and Rs 125 for those from SC-ST background.

The judgement, written by Chief Justice Chandrachud, emphasized that excessive fees violate the constitutional right to equality and professional practice, as outlined in Articles 14 and 19(1)(g). The ruling aims to remove financial barriers and ensure equal participation in the legal profession.
